CMS Issues Final Home Health Services Conditions of Participation

The Centers for Medicare and Medicaid Services (CMS) issued its final rule outlining new Conditions of Participation (CoPs) for Home Health Agencies. These rules apply to certified home health agencies providing skilled home health services to patients enrolled in Medicare and/or Medicaid.  The first rule establishing the federal CoPs for home health agencies were finalized in 1999.  CMS issued their draft proposal to update the home health CoPs in October 2014 and accepted comments from the public for 60 days following the release of their proposal.  This new final rule was published in the Federal Register on January 13, 2017.  The effective date for all provisions included in this new rule will be July 13, 2017.  Through this new rule, CMS has proposed changes to transform the industry by “revising the home health agency requirements to focus on a patient-centered, data-driven, outcome-oriented process that promotes high quality care at all times for all patients.” Council members should contact Lisa Gurgone, lgurgone@hcacouncil.org, for an in-depth explanation of the revised regulations.
